The role of the Federal Energy Regulatory Commission

Some dams in Wisconsin are also under the jurisdication of the Federal Energy Regulatory Commission (FERC). To determine the authority that a state has in reference to dams regulated by the FERC, the FERC license must be reviewed. FERC generally supersedes Wisconsin Statues Chapter 31; however, in certain instances, FERC may provide for Wisconsin Department of Natural Resources involvement in the license articles. Dams that receive a FERC exemption are considered to be under the jurisdiction of the Wisconsin Department of Natural Resources.
